Background

1. The Applicant filed his RTI request on 12.03.09 with the PIO, DMW, Patiala seeking
information related to the selection of Section Engineer in Diesel Trade at DMW. He
stated that he got 60% marks under various heads and even then the Dy. Chief
Personnel Officer vide letter dated 26.08.08 has indicated that he is placed in the
relaxation standard. He wanted to know which was the part in which relaxation was
given to him. The PIO replied on 15.04.09 providing point wise information. Not
satisfied with the reply, the Applicant filed his First Appeal on 29.04.09 stating that
information provided is not relevant to what he is seeking. The First Appellate
Authority vide order dated 27.05.09 provided further clarification with regard to the
relaxed/general standards. Being aggrieved with the reply, the Applicant filed his
Second Appeal on 23.06.09 before the Commission.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing for 21st January, 2010.

3. Mr. Vinod Kumar, Dy. CPO-cum-PIO represented the Public Authority.

4. The Appellant was present during the hearing.
Decision

5. The Respondent submitted that the Appellant had filed another RTI Application on the
same issue and that the Appellant has already been allowed to inspect his file and also
that even the Chairman of Railway Board has given him a personal hearing at a
meeting at the National Commission for Scheduled Castes. The Appellant however,
was not willing to accept the reasons for his non selection. The Respondent also stated
that the marks given in the selection process have also been shared with the Appellant
and that he was informed why he has failed in the examination.

6. The Commission on review of the information provided holds that complete
information has been furnished to the Appellant and advises him to approach an
appropriate forum for redressal of his grievance. and accordingly disposes off the
appeal.
