Background
1. The applicant filed an RTI application dt.31.8.06 with the CPIO, WCR, Kota.
He requested for information against various points related to his seniority,
promotion, payment of arrears, and 76 days of LAP(1.1.96 to 16.3.96) . The
CPIO replied on 11.12.06 providing pointwise information. Not satisfied with
the reply, the Applicant filed an appeal dt.2.4.07 with the Appellate Authority.
The Appellate Authority replied on 14.5.07 providing further clarification,
pointwise. Aggrieved with the reply, the Applicant filed a second appeal
dt.14.6.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 10, 2009.
3. Mr.N.K. Mishra, PIO and Mr. G.P. Sain, O.S. I represented the Public
Authority.
4. The Applicant was present during the hearing.
Decision
5. The Appellant stated that after being relieved by the Wagon Repair Shop,
Kota, he joined the Territorial Army to work there and when the TA relieved
him after a month he again joined Railway duty. In this connection, he
wanted the Commission to provide him the reasons for not being paid 76
days of LAP(1.1.96 to 16.3.96). The Respondent submitted that
information/reasons with regard to his claim of 76 days of LAP has already
been provided on 14.5.07 and 4.7.07. The Commission reviewed the
information provided on this subject and noted that information has been
furnished to the Appellant . All other information has been already furnished
to the Appellant. The appeal is accordingly disposed of.
