CORAM: HON'BLE MR. JUSTICE KANWALJIT SINGH AHLUWALIA.

Present: Mr.Baldev Singh, Senior Advocate
         with Mr. Arshvinder Singh, Advocate
         for the petitioners.

Mr. Sunil Nehra, Assistant Advocate General,
          Haryana, for the respondent-State.

Kanwaljit Singh Ahluwalia, J. (Oral)

Yesterday, I have granted bail to the co-accused Suman Jain

solely on the ground that she is lady.

Mr. Sunil Nehra, learned Assistant Advocate General,

Haryana, on instruction from Inspector Hari Ram of Police Station

Sushant Lok, Gurgaon, states that Anil Kumar and other accused made

disclosure statement that the petitioners were the persons who had

hired the assailants for commission of murder.

This contention of Mr. Nehra is contested by Mr. Baldev Singh,

Senior Advocate, who says that there is no evidence to this effect on

the case file.

Be that as it may, no ground is made out to grant pre-arrest

bail to the petitioner. The trail Court after looking into the entire evidence
Criminal Misc. No. M-16893 of 2008 2

will decide the regular bail application of the petitioners in case the same

is filed within three days. Since the petitioners have been on pre-arrest

bail, their arrest is stayed in the present case for another period of seven

days to approach the concerned Court.

With these observations, the present petition is disposed off.
