ORAL
ORDER

(Per
: HONOURABLE MR.JUSTICE R.P.DHOLAKIA)

1. Rule.

Mr. H.L. Jani, learned APP, waives service of Rule for the
respondent.

2. The
applicant-convict has sent this application through jail authority
wherein he has prayed for regular bail on the ground that he has
already undergone sentence of eight and half years. We have through
the application and it is found that he is the accused in a case for
the alleged commission of offence under the provisions of NDPS Act
and he has been convicted for a period of 15 years and to pay fine of
Rs.1,50,000/-. We are of the opinion that no case is made out for
grant of regular bail to the applicant.

3. The
appeal of the applicant is of the year 2002. At present this court is
taking up the appeals of the year 2002 and therefore, as per its turn
the appeal of the applicant will be listed for hearing.

4. In
view of the above this application is rejected. Rule is discharged.
