Facts
arising from the Complaint:
Mr. I. Nicholas had filed an RTI application with the PIO-Library Cell,
Department of Education, 58, Darwari Lal Sharma Road, Lucknow, U.P. on 13/08/2009
asking for certain information. Since no reply was received within the mandated period of
30 days, he had filed a complaint under Section 18 to the Commission on 13/10/2009.
The Central Information Commission registered the complaint. Subsequently a
notice dated 13/10/2009 was sent by the Commission. This was an inadvertent error on
part of the Commission, as the Respondent Library Cell does not come under the
jurisdiction of Central Information Commission but under the jurisdiction of the Uttar
Pradesh State Information Commission. The entire Complaint is now being sent to the
Uttar Pradesh State Information Commission, for necessary action at their end.
Decision:
The Complaint is infructuous.
