The petitioner apprehends arrest in a crime registered inter alia,
under Section 406 I.P.C. There are three accused named in the F.I.R. The
allegation is in respect of transactions in respect of a vehicle. The petitioner
apprehends that he may unnecessarily be arrayed as an accused.
2. The learned Prosecutor, after taking instructions, submits that
the petitioner is not required to be arrested in connection with Crime No.20
of 2007 of Thalasserry Police Station and the petitioner will not be arrested
in that crime. If in future such arrest be necessary, this Court shall be
informed of such requirement and only after seeking appropriate further
directions, shall such arrest if at all necessary be effected, submits the
Prosecutor.
2. The submissions of the Prosecutor are taken note of and recorded.
It is now evident that the apprehension of the petitioner is not real and
reasonable now.
3. This application is hence dismissed with the above observations.
