ORDER

Rule.

Learned A.P.P. Mrs M.L.Shah, waives service of notice of rule on
behalf of the respondent-State.

Heard
learned advocate for the applicant and learned Additional Public
Prosecutor for the State.

2. Following
aspects are considered :-

(1) Eye
witness has alleged giving of kick and fist blows only.

(2) The
medical certificate supports the version of the eye witness
indicating that all the external injuries were abrasion, except one
haematoma.

3. Considering
the above aspects, the application deserves to be allowed and the
same is allowed. The applicant is ordered to be released on bail in
connection with Crime Register No. I- 58 of 2010 of Sector-7
Police Station, Gandhinagar, on his executing a bond of Rs. 10,000/-
(Rupees ten thousand only) with one surety of the like amount to the
satisfaction of the lower Court, subject to such conditions which the
lower Court may deem fit to impose.

4. Rule
is made absolute.

5. Direct
Service is permitted.
