The petitioners are accused for the offence under Section 7 of
the Essential Commodities Act read with Section 120B of the Indian
Penal Code.
Heard learned counsel for the petitioners and learned counsel
for the State.
It is submitted on behalf of the petitioners that petitioner No. 1
happens to be the driver of the tractor seized in this case while the
remaining two petitioners are staff of co-accused Surendra Agrawal
and as a matter of fact, they do not have any concern whatsoever
with the food-grains which have been seized in this case since
admittedly the food-grains belong to co-accused Surendra Agarwal.
It is lastly submitted that the petitioners have no criminal
antecedents to their discredit yet they are in custody since
14.08.2008.
Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances of the case, the
petitioners above named, are directed to be released on bail on their
furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each
with two sureties of the like amount each to the satisfaction of the
Chief Judicial Magistrate, Pakur in connection with Pakur (M) P.S.
Case No. 168 of 2008 corresponding to G.R. No. 516 of 2008.
