3/ 1.4.2011 Heard learned counsel for the parties on the prayer of the

appellant for bail after receipt of the lower court records.

It was contended that the appellant had been convicted

under sections 376/511 of the IPC and the evidence may indicate

that it may not be a case under sections 376/511 of the Code.

Regard being had to the facts and contentions, let

appellant Abhiram Malakar, during the pendency of the appeal, be

released on bail on furnishing bail bond of Rs.10000/(ten thousand)

with two sureties of the like amount each to the satisfaction of

Additional District and Sessions Judge FTC I, Begusarai in S.T. No.

365 of 1999.
