02/ 21.11.2011 Heard learned counsel for the petitioner as well as learned
Addl. P.P. for the State.
Petitioner is an accused in a case registered under section
395 of the IPC and earlier he was granted privilege of bail by this
court.
It appears from the impugned order that on 18.1.2006 case
was fixed for prosecution evidence and two prosecution witnesses had
made their appearance but none turned up on behalf of the petitioner
when the case was called out as a result of which bail bond of the
petitioner was cancelled and later on, petitioner surrendered on
3.9.2011 before the trial court.
Taking into consideration the above stated facts and
circumstances as well as submissions of the parties, let the petitioner,
Abodh Kumar, be released on bail on furnishing bail bonds of Rs
10,000/- with two sureties of the like amount each to the satisfaction
of the Addl. Sessions Judge XIV, Patna in Sessions Trial no. 516/2005
arising out of Phulwarisharif P.S. Case no. 528/2003 subject to the
conditions that petitioner shall ensure his presence before the learned
trial court on each and every date for the period of nine months and if
he fails to do so on three consecutive dates without any reasonable
explanation, the learned trial court shall be at liberty to cancel the bail
bonds of the petitioner.

It goes without saying that the learned trial court shall take
all effective steps to conclude the trial of the petitioner within the
above stated period of nine months.
