Rejoinder affidavit filed today is taken on record. Along with the rejoinder
affidavit is annexed an order of the Apex Court dated 9.7.2009 whereby the
petition for Special Leave to Appeal (Civil) No.21318 / 2007 filed by the
State of U.P. against the judgment and order of this Court dated 11.5.2006 has
been dismissed.
This contempt application has been filed alleging non-compliance of the
judgment and order dated 11.5.2006 passed in Writ Petition No.31717 / 2002.
Special leave petition having been dismissed by the Apex Court, the State is
now obliged to make full compliance of the judgment of the Division Bench.
Almost six months has passed since the special leave to appeal was dismissed
by the Apex Court. It is the high time that the judgment of this Court be
complied with.
Sri K.R. Singh, learned standing counsel prays for and is allowed two weeks
time to obtain instructions and inform this Court about the status of the
compliance.
