Heard Shri Ratan Lal learned counsel for the applicant and
learned AGA for the State. On this application for bail moved on
behalf of Achche Lal Patel , Nathu Lal Patel, Laxmi Patel and
Indra Prasad Patel moved in Case Crime no. 72 of 2009 under
Sections 147, 148, 387, 323, 504, 506 and 325 IPC and 12/14 D.

Learned counsel for the applicant has contended that in view of
the prosecution case on 11.05. 2009 at about 5, the complainant
Saddhu Yadav was carrying cement in his tractor for construction
for construction of Chek Dam and when he reached on the spot
Sunder Patel, Swadesh Patel alias Balkhadia, Chunni Lal Patel,
Vijju Mama alias Suresh Singh Gaur along with 8-9 unknown
persons belonging to Ragia Gang armed with guns reached the
spot and made a demand of Rs. 50,000/- at gun point. They blowed
him from Lathi and also abused him.
Learned counsel has further submitted that this FIR was lodged in
complaince of order passed by the Magistrate on application
moved under Section 156(3) Cr.P.C. and the applicant have been
falsely implicated in this case while no such offence has taken
place. More over the applicants are not named in the FIR and no
independent witness has been sited therein. More over the
applicants are lying in judicial custody since 24.05.2009.
Considering the facts and circumstances of the case the
application for bail is allowed and each of the applicants is
directed to be released on bail subject to his furnishing two
sureties and personal bond each in the like amount to the
satisfaction of the court concerned.
