Heard learned counsel for the applicant and learned A.G.A. for the State.
The accused applicant Ajit Kumar Pandey is involved and detained in Case
Crime No. 991 of 2008, under Sections 302, 504, 120-B I.P.C. and under
Section 7 of the Criminal Law Amendment Act, from Police Station Ashoha,
District Unnao and he has applied for bail.
The submission of the learned counsel for the accused applicant is that the co-
accused Keshan Kumar and Surya Kant having similar role as the present
accused applicant have already been ordered to be released on bail by this
Court, vide detailed and reasoned order dated 7.1.2010, passed in Criminal
Misc. Case No. 116 (B) of 2010. Therefore, the present accused applicant also
deserves to be released on bail on the ground of parity.
Learned A.G.A. although opposed the prayer for bail but fairly accepts that
the co-accused Keshan Kumar and Surya Kant having identical role as the
present accused applicant have already been ordered to be released on bail.
Considering the submissions of learned counsel for the applicant, learned
A.G.A. as well as keeping in view the fact that the co-accused having
identical role as the present accused applicant have already been ordered to be
released on bail by this Court, without expressing any opinion on the merits of
the case, the accused applicant may be released on bail.
Let applicant Ajit Kumar Pandey be released on bail in the aforesaid case
crime number on his furnishing a personal bond with two sureties each in the
like amount to the satisfaction of the court concerned.
