The aforesaid two petitions have been filed by the petitioners
Ajit Singh and Gurmail Singh for quashing arise out of the one and the same
i.e. F.I.R. No.221 dated 16.09.2006 under Sections 420, 465, 468, 471 of
I.P.C. registered at Police Station Dharamkot, District Moga, therefore, both
the petitions are being disposed of by this common order.
Without going into any further details, suffice it to say that the
aforesaid case was registered at the instance of Malkiat Singh respondent
Criminal Misc.No.M-3371 of 2009 of(O&M) -2-
No.2-complainant, who is present in the Court today and identified by his
counsel Sh.S.C.Chhabra, Advocate. On the asking of the Court, Sh.Malkiat
Singh respondent No.2-complainant states that he has already arrived at
compromise with the petitioners and further states that this case was
registered due to mis-understanding between the parties. It is further stated
that Malkiat Singh respondent No.2-complainant is a producer of
agricultural crop and used to sell the same to the petitioners, who are his
commission agent. The matter has been settled amicably with the
intervention of the respectable and common relations. In this regard,
compromise affidavit dated 22.12.2008 of Malkiat Singh respondent No.2-
complainant (Annexure P1) has also been placed on the file.
In the given facts and circumstances, this Court feels that no
useful purpose would be served if the proceedings in the case in hand are
allowed to continue. Moreover, it would also be in the interest of peace and
harmony between the parties to close the chapter of this case.
In the result, both the petitions succeed and consequently F.I.R.
No.221 dated 16.09.2006 under Sections 420, 465, 468, 471 of I.P.C.
registered at Police Station Dharamkot, District Moga and all subsequent
proceedings arising therefrom are hereby ordered to be quashed, qua both
the petitioners namely Ajit Singh and Gurmail Singh.
