ORDER

1. Heard
learned advocate Mr.P.A.Jadeja for petitioner and learned AGP
Mr.A.L.Sharma for respondent No.1.

2. In
present petition, petitioner has challenged clause (11) of public
notification dated 9.6.2010 which has been issued by respondent No.2,
without giving any application for licence of restaurant and hukka
bar to respondent No.2.

3. Therefore,
let petitioner may approach to respondent No.2 Commissioner of
Police with an application to have the licence or permission for
restaurant and hukka bar.

4. As
and when such application is received by respondent No.2
Commissioner of Police, Ahmedabad city, it is directed to respondent
No.2 Commissioner of Police to consider the application made by
petitioner and examine his grievance and then, to pass appropriate
reasoned order in accordance with law and communicate the decision to
petitioner immediately.

5. In
view of aforesaid observations and directions, present petition is
disposed of without expressing any opinion on merits.
