Court No. - 47 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 1222 of 2010 Petitioner :- Akbar Respondent :- State Of U. P. Petitioner Counsel :- Sunil Kumar Pathak Respondent Counsel :- Govt Advocate Hon'ble Amar Saran,J.
Heard learned counsel for the applicant and learned Additional
Government Advocate.
It is argued by the learned counsel for the applicant that this is a
case of circumstantial evidence and apart from the evidence of
extra-judicial confession, which is an inherently weak kind of
evidence, there is no other evidence.
Learned AGA, however, argued that the applicant has the motive
for committing this crime and there is no reason for his false
implication.
Having considered the submissions of the parties and without
expressing any opinion on the merits of the case, let the applicant
Abrar, involved in case crime No. 431 of 2009, under sections
302/201 IPC, police station Atmadpur, district Agra, be released
on bail on his furnishing a personal bond with two sureties each in
the like amount to the satisfaction of the Court concerned.
