In
this petition, which is in the nature of public interest litigation,
the petitioner ? Akhil Gujarat Machhimar Mahamandal, seeks a writ
of mandamus against the respondents, directing the authorities to
take action against the 8th respondent for starting to
break ship being AGROUNDED MV RONGA without obtaining necessary
permission from the 2nd respondent and other competent
authorities.

Learned
counsel appearing for the 2nd respondent submits that the
permission to break the ship has already been granted by letter dated
16th April 2008.

In
view of the above, we find it unnecessary to examine the various
contentions raised in this petition. Needless to say, in case of any
breach or non-compliance of any of the conditions imposed by the 2nd
respondent in the permission/letter dated 16.04.2008, it is open for
the 2nd respondent to take necessary action in the matter.

With
the above observation, the Special Civil Application stands
dismissed.
