The controversy involved in this petition for writ is no more
res integra in view of the judgment of this Court reported in
2009 WLC (Raj.) UC 226 - Krishan Chand Sharma Vs. State of
Rajasthan and Ors.
Accordingly, this petition for writ too is disposed of in
terms of the judgment referred above. The respondents are
directed to ascertain the fact about working of the petitioner with
Panchayat Samiti from the date on which the decision was taken
by the Government for absorption of Assistant Secretaries as
Secretary. If the petitioner is found working as Assistant
Secretary with the Panchayat Samiti at the relevant time, he be
absorbed as Secretary with all benefits which were extended to
other similarly situated persons.
