Judgment

Basheer, J:

This appeal is posted before the Bench since appellant has

not taken steps to serve notice on respondent No.1 so far. On May

20, 2010 this Court had directed the appellant to take out notice to

respondent No.1 through paper publication within 5 days. But till

today no steps have been taken. Today when the case is taken up

for consideration neither the appellant nor his counsel is present.

Therefore the appeal is dismissed for non prosecution
