There are two prayers in the writ petition. First

one is to allot to the petitioner one of the seats

reserved for NCC quota. Even going by the averments in

the writ petition, only two seats are reserved and have

already been allotted. The claim raised by the

petitioner on the 3rd seat is on the basis of Ext. P2.

In view of the provision contained in the prospectus

which in clear terms provide that there are only two

seats in the particular quota there cannot be a claim

for the 3rd seat.

2. In so far as the second prayer is concerned, it

is for a direction to allot students to all vacancies

in the Self Financing Colleges before 30-9-2007. It is

averred in paragraph 6 of the writ petition that even

after the second allotment, there are vacancies and

those seats should also be filled up.

3. Learned Govt. Pleader, on instructions, submits

that in terms of the prospectus and the guidelines,

WPC No. 28359/07 -2-

with the allotment of the second batch, the allotment

of students to these vacancies is also over. If that

be the general guideline in respect of Self Financing

Colleges, I see no justification for interference with

that issue also. Hence, the second prayer sought for

also cannot be granted.

The writ petition fails and is dismissed.
