ORDER
The
grievance which is voiced in the present petition is that though the
petitioner has approached
the Director of Municipalities by submitting application
dtd.22/5/2010 to inquire into the allegations with respect to
conduct of the members/councillors of Kapadvanj Nagar Palika and
approached the Director of Municipalities for taking action under
sec.37(1) of the Gujarat Municipalities Act, but not steps are
taken.
In
view of the above, without entering into the merits of the case
and/or without expressing any opinion on merits with respect to the
allegations made by the petitioner
in the application dtd. 22/5/2010 to the Director of Municipalities,
as it is reported that no steps are taken and no decision is taken,
the Director of Municipalities is hereby directed to look into the
same and inquire into matter, after following the due procedure of
law and if it is found that there is some substance in the
allegations made by the petitioner
with respect to the allegations made by the petitioner
in the application dtd. 22/5/2010, in that case, the
Director of Municipalities to initiate appropriate proceedings
against the erring members/councillors and/or office bearers, in
accordance with law and on merits, after following due procedure of
law, for which this Court has not expressed any opinion with regard
to the allegations made by the petitioner
in the application dtd. 22/5/2010. However, such exercise
shall be completed at the earliest.
With
these present petition is disposed of.
