Heard learned counsel for the applicant and learned Additional
Government Advocate.
It is argued by the learned counsel for the applicant that one of the
parties had let loose a dog leading to this incident. Initially the case
was registered as a NCR case under sections 323/504 IPC, but
subsequently after the deceased died the case was converted to one
under section 304 IPC. The incident has taken place all of a sudden
and the co-accused Asish has been granted bail. The case of the
applicant cannot be distinguished from that ofAshish, who was
assigned Sariya and the applicant was assigned Lathi in the 161
Cr.P.C. statement and in the FIR four persons are said to have
assaulted the deceased Ashraf.
Learned AGA opposed the prayer for bail.
Having considered the submissions of the parties and without
expressing any opinion on the merits of the case, let the applicant-
Alok Kumar, involved in crime No. 423 of 2009, under sections
323/504/304 IPC IPC, police station Kheta Sarai, district Jaunpur,
be released on bail on his furnishing a personal bond with two
sureties each in the like amount to the satisfaction of the Court
concerned.
