Heard learned counsel for the applicant.

The applicant alleges that the order dated 27.08.2009 passed in Writ Petition
No. 4132 of 2006 has been violated. From a perusal of the application, a
prima facie case has been made out.

Let notices be issued to the opposite party within a week, returnable within
six weeks by which time counter affidavit may be filed failing which the
charges may be framed after summoning him.

It is, however, open to the opposite party to comply with the order of this
Court and file an affidavit of compliance on or before the date fixed.
The opposite party need not appear in person at this stage. Office is directed
to send a copy of this order along with the notice.
