02. 06.09.2011 Heard learned counsel for the petitioner and learned

Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection

with Complaint Case No. 1265/2001, (Tr. No. 2625/2011) for

the offences under Sections 323, 420, 406, 423 and 504 of the

Indian Penal Code, pending in the court of Sri R.K. Divedi,

Judicial Magistrate, 1st Class, Gopalganj.

After some arguments, learned counsel for the

petitioner seeks permission to withdraw this application with

a liberty to surrender before the court below within a fortnight

and seek regular bail.

Permission is granted. On such prayer, regular bail

of the petitioner shall be considered by the court below on its

own merit without being prejudice of instant withdrawal.

Accordingly, this application stands disposed of

as withdrawn.
