1. Respondent
party-in-person Rekhaben Ambalal Gurnani is present in the Court.
She is identified to be Rekhaben Ambalal Gurnani by learned Advocate
Ms. Vinita Vinayak. Party-in-person makes a statement before the
Court that she will withdraw the H.M.P.No. 159 of 2007 filed in the
Court of 5th Additional Senior Civil Judge & Judicial
Magistrate First Class, Gandhinagar within one week from today.
2. On
the statement being made, the learned Advocate for the petitioner
seeks permission to withdraw the petition. Permission is granted.
Petition is disposed of as withdrawn.
3. Initially,
an amount of Rs.1 lac was deposited by the present petitioner before
this Court. The learned Advocate for the petitioner requests that the
Registry be directed to return that amount to the petitioner.
Party-in-person Rekhaben Ambalal Gurnani has no objection if this
amount is returned to the petitioner.
Registry
is directed to return the amount to the petitioner by A/c. Payee
Cheque on or before 19th April, 2010.
