Heard learned counsel for the applicant and learned A.G.A.
The applicant is accused in case crime No. 769 of 2009 ( Case No.
3845/2009) under sections 498A, 304-B, and 3/4 D.P.Act, P.S. Loni, District
Ghaziabad, pending in the court of learned 1st ACJM Ghaziabad.
This application has been filed with a prayer that a suitable direction may be
issued to the courts below for disposal of the bail application of the applicant
on the same day.
After perusing the record and considering the nature of the allegations it is
directed that in case applicant moves application for appearance/surrender
before the court concerned within 30 days from today on which the court
concerned shall fix the date of surrender/appearance, in the meantime the
court concerned shall seek the instructions from the prosecution side. In case
the applicant moves the application for bail on the day of the appearance or
surrender, the same shall be heard and disposed of expeditiously by the
courts below.
With the above direction, the application is finally disposed of.
