1. Rule.

Mr. Kodekar, learned APP, appears and waives service of rule on
behalf of the respondent State of Gujarat.

2. Having
regard to the facts of the case, the application is taken up for
hearing today.

3. At
the time of hearing of the application Ms. K.U. Mishra, learned
advocate for the applicant does not press the application and seeks
leave to withdraw the same.

4. Mr.

Kodekar, learned APP, has no objection if leave as prayed for is
granted.

5. Hence
leave to withdraw the application is granted. The application stands
