ORAL ORDER

(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)

This
application is preferred bringing on record the developments as taken
place during pendency of the case. It is stated that the appellant
moved before the Inquiry Commission pursuant to this Court’s
observations, but the same has been rejected by the Commission. For
the said reason, a prayer has been made to amend the prayer as sought
for in the draft amendment petition.

Having
heard the learned counsel for the parties, and taking into
consideration the nature of the case, we allow the application and
thus allow the appellant to amend the prayer. All the statements
made in the draft amendment petition shall be treated as a part of
the pleading of the appellant.

This
Civil Application stands disposed of.

The
learned Advocate General may obtain instructions in the light of the
recent order passed by Commission.

Post
the matter on 15th December, 2010.
