ORDER

1. Heard,
learned Advocate Mr. Pranav Raval, appearing on behalf of applicant.
The respondent no. 1 – Shabbir Hussain Ghulamhussain Fakir and
respondent no. 2 – Devangbhai Naranbhai Waghela have personally
remained present before this Court. Rule is served to respondent no.
3 – New India Assurance Co. Ltd. but no appearance is filed by
respondent no. 3.

2. This
application is preferred by application – claimant with a prayer to
condone delay of 16 days in filing First Appeal.

3. Considering
submissions made by learned Advocate Mr. Raval, Party in Person –
respondent nos. 1 & 2 and also considering averments made in this
application supported with affidavit, delay of 16 days is condoned in
the interest of justice as sufficient cause is shown by the applicant
to the satisfaction of this Court. Rule is made absolute
accordingly.
