has been revised twice, learned advocate Mr. AR Majmudar appearing
on behalf of appellant and learned advocate Mr. JM Patel appearing
for respondent not remained present on both occasion when matter has
been called out. Today, either of advocate has not filed any sick
note or leave note or no advocate has mentioned on their behalf.

Therefore,
in such circumstance as well as considering matter is of 1993, more
than seventeen years have passed no care has been taken by either of
advocate when matter has been called out twice, this Court is having
no other option except to dismiss matter in default.

Accordingly,
present second appeal is dismissed in default.
