Learned
advocate for the petitioner submitted that in the application Exh.15
filed by the petitioner original defendant, the present
respondent original plaintiff has not filed any reply. He further
submitted that Special Civil Suit No.14 of 2004 has been filed by the
respondent herein with respect to very same transaction for which the
petitioner had filed a suit before the learned Civil Judge (S.D.),
Jodhpur and the said suit was decreed. In the said suit, the present
respondent had not set up any counter claim.

Considering
the submissions made, issue NOTICE returnable on 14.10.2008.
