The petitioner ought not have filed a

Cr.Revision Petition for release from

wrongful confinement because her confinement

is not in capacity of an accused in

connection with Sessions Trial No.782 of

2009. She could, at best, be a witness which

also does not appear a case from her

statement recorded under Section 164 Cr.P.C.

which is attached as Annexure-2 to the

present petition. The petitioner should take

steps for conversion of this petition into

Cr.Writ Jurisdiction Case so that the

petition may be listed before the appropriate

Bench under the orders of Hon’ble the Chief

Justice.
