Heard learned counsel for the petitioners and learned Standing
Counsel.
By order dated 07.02.2009, petitioners were transferred from civil
police to armed police for a period of six months. Petitioners
submit that in spite of the expiry of the aforesaid period, the
petitioners have not been sent back to their original cadre of civil
police. To this effect the petitioners have submitted representations
dated 20.3.2010 (Annexure-3 to the writ petition) before the
respondent No.2 i.e. the Senior Superintendent of Police,
Ghaziabad. The said representation for repatriation is still pending
and has not yet been decided.
In view of the aforesaid facts and circumstances of the case, the
present writ petition is being disposed of with a direction to the
respondent No.2 i.e. the Senior Superintendent of Police,
Ghaziabad to consider and decide the petitioner’s representation
dated 20.3.2010 (Annexure-3 to the writ petition), in accordance
with law keeping in view of the circular dated 16/10/2006, issued
by Director General of Police, Uttar Pradesh as expeditiously as
possible preferably within a period of two months from the date of
production of the certified copy of this order.
The writ petition is disposed of accordingly.
There shall be no order as to costs.
