1. During investigation, the offence under Section 315 of Indian Penal Code has been added against the petitioners. Learned State counsel states that the petitioners have not joined investigation ever since the and they are absconding. The petitioners who were earlier admitted to regular bail by the Judicial Magistrate Ist Class, Safidon, have now applied for anticipatory bail after the addition of the offence under Section 315 IPC.
2. In this case, the women folk who were not able to make their escape good, have admittedly been arrested along with a one year old child and they all are in jail since 31.12.2002. There is no ground for anticipatory bail to the petitioners. However, in case they surrender before the trial court on or before 18.2.2003 and apply for regular bail, the trial court would dispose of their application for regular bail together with any request for remand that may be made by the investigating agency after taking into consideration the material produced by it, as expeditiously as possible. This petition stands disposed of accordingly.
