Order

In this petition, the petitioner prays for an order,

dispensing with his personal appearance in CC

No.12/2010 on the file of the Chief Judicial Magistrate’s

Court, Thodupuzha.

2. The petitioner is the sole accused in CC

No.12/2010, which was initially taken on file as CC

No.155/07 before the Chief Judicial Magistrate’s Court,

Thodupuzha for having committed the offences punishable

under Ss.279 and 304A IPC and S.134(a) & (d) r/w S.184

of the Motor Vehicles Act. The details of the case are

unnecessary for the present purpose.

3. It is pointed out in the petition that the trial

had commenced and three witnesses had been examined.

Three independent witnesses turned hostile. In the

meantime, the petitioner secured a job abroad and went to

his place of employment. Thereafter, he could not appear

before Court and subsequently, his case was included in

the LP Register and renumbered as LPC No.49/08. On

01.02.2010, the petitioner came back to his native place

and he surrendered before the Court. He was remanded to

judicial custody on 01.02.2010 and released on bail on

02.02.2010. The petitioner now prays that his personal

appearance in the case may be dispensed with for the

subsequent postings.

4. The petitioner has the liberty to move a

petition under S.205 Cr.P.C. before the Court below. If

such a petition is filed, the Court below shall consider and

pass appropriate orders thereon in accordance with law as

expeditiously as possible.

The petition is disposed of as above.
