ORAL ORDER

(Per : HON’BLE MR.JUSTICE AKSHAY H.MEHTA)
Rule. Mr.R.C.Kodekar, learned APP waives service.
The wife of the convict prisoner, Mahmoodmiya Alias
Mulla Shaikh has applied for temporary bail of her husband.
The application is filed on the ground that her son is
required to be operated upon. In support of her say, she
has produced the medical record of V.S.Hospital, which
confirms this fact.

We have perused the jail record of the convict
prisoner. In the circumstances, we direct that the jail
authorities shall release the convict prisoner on temporary
bail for a period of fifteen days from the date of his
release on his executing a personal bond in sum of Rupees
Two thousand only before the jail authorities on usual terms
and conditions and on a further condition that he shall mark
his presence at Vejalpur Police Station on each Saturday any
time between 11.00 a.m. and 5.00 p.m. He shall surrender
to the custody after the expiry of the temporary bail
period. Rule is made absolute.
