1. We have
heard learned counsel Mr. Manav A. Mehta for the appellant and
learned Assistant Government Pleader Ms. Jirga Jhaveri for the
respondent.
2. The
learned Single Judge has decided in favour of the petitioner and set
aside the order of compulsory retirement and modified the punishment.
Appeal against such an order is not maintainable as the appellant is
not an aggrieved person. No appeal lies against the finding or
punishment which was modified in favour of the petitioner. This
appeal is dismissed.
