Heard
learned Advocate Mr. Divetia for the petitioners and Mr. Balar for
the respondent No.2. Mr. Divetia has vehemently argued that the
first Appellate Court – Sixth Additional District Judge, Vadodara,
has committed an error in allowing the Appeal, being Civil Misc.
Appeal No. 11 of 2009, by Order dated 23.04.2009.

Having
gone through the Order and more particularly the contents of para-12
of the Order, this Court is of the opinion that, the learned Judge
has not committed any error, which warrants interference by this
Court. This petition fails and is rejected.
