advocate Mr.Mehul M.Mehta for the petitioner states that as the suit
Regular Civil Suit No.59 of 2009 is dismissed for default, he is
not able to proceed further with this matter.

He seeks
liberty to file a fresh petition for the same cause of action after
the suit is restored to file on passing of an order on the
application for the same.

The present
petition is disposed of with the aforesaid liberty.
