                             J U D G M E N T

The petitioners filed Ext. P1 application before the 2nd

respondent for permission under Kerala Land Utilisation Order to

convert their wet land into dry land for the purpose of construction of

residential houses. The petitioners submit that the same is not being

considered on the ground that a Bill for amending the Kerala Land

Utilisation Order has been introduced in the Assembly.

2. I have heard the learned Government Pleader also.

3. This Court had, in several writ petitions, one of which is

Ext. P3, held that the introduction of a Bill for amendment of the

Kerala Land Utilisation Order in the Assembly is no ground for

postponing consideration of applications filed under the Kerala Land

Utilisation Order in accordance with the present law. That being so,

there is no justification for the 2nd respondent to postpone

consideration of Ext. P1 any further. Accordingly, the writ petition is

disposed of with a direction to the 2nd respondent to consider and

pass orders on Ext. P1 in accordance with law as it obtains today, as

expeditiously as possible, at any rate, within one month from the date

of receipt of a copy of this judgment.

The petitioner shall forward a certified copy of this judgment

along with a copy of the writ petition to the 2nd respondent for

compliance.
