04/ 30.09.2011 From the letter of the trial court (Additional
Sessions Judge VI, Patna) dated 27.9.2011 as also the
report of the O.S.D. of this Court dated 29.9.2011, it
appears that four prosecution witnesses, who have
been recalled for examination under Section 311
Cr.P.C., are not appearing for their re-examination
and the Senior Superintendent of Police, Patna is also
not taking any action in the matter.
Petitioner is languishing in jail since
8.9.2007 i.e. for more than four years.
Let the Senior Superintendent of Police,
Patna ensure appearance of the four witnesses in the
trial court on 13.10.2011, the next date fixed in the
trial (Sessions Trial No. 632 of 2008), failing which
he should appear in this Court on 14.10.2011 at
10.30A.M.
