Heard learned counsel for the applicant and learned AGA.
Learned counsel for the applicant contended that pure business transaction
dispute has been dragged into criminal court and the entire evidence on
record indicates only civil dispute regarding payment of money. It is further
contended that no offence is made out against the applicants.
Issue notice to the respondent no. 4 returnable at an early date. Learned AGA
and respondent no. 4 may file counter affidavit within three weeks.
List in the week commencing 27.9.2010.
Till the next date of listing, proceedings of Case No. 679/10, State vs. Ashish
Katyal and others, pending in the court of ACJM, I, Bareilly, u/s 406 read
with section 420 IPC, P.S. Baradari, district Bareilly shall remain stayed
