Heard learned counsel for the petitioner and learned standing counsel
representing on behalf of respondents.
By the impugned order dated 19.5.2010 the respondent no. 5 has suspended
the license of the petitioner. It is recorded that the petitioner did not submit
any reply to the two show cause notices issued to the petitioner on 29.8.2009
and 11.2.2010.
Learned counsel for the petitioner has submitted that the petitioner has
submitted detailed reply to both the show cause notices, which have been filed
as Annexure no. 6 and 8 and bear the stamp of the office of respondent no. 5.
It is further submitted that without considering the said objection a wrong fact
has been recorded in the impugned order that no reply was submitted.
In view of the above, the effect and operation of the impugned order dated
19.5.2010 passed by respondent no. 5 (Annexure no. 1 to the writ petition)
shall remain stayed.
