Heard learned counsel for the applicant and learned A.G.A.
appearing for the State.
It is contended by the learned counsel for the applicant that the
information was given by the village chowkidar and there was no
allegation against any person and thereafter statement of co-
accused Dharmendra was recorded in which he has assigned role
catching hold to the applicant. The main shooter is Situ alias Rajiv.
Learned A.G.A. contended that role of the applicant is of catching
hold and he was also involved in committing the murder of the
deceased.
Case is based on circumstantial evidence. Applicant has no
criminal history and he is in jail since 23.4.2010.
Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant and
without expressing any opinion on the merits of the case, the
applicant is entitled to be released on bail.
Let the applicant Ashok Kumar involved in Case Crime No. 89 of
2010, under Sections 302/34 IPC Police Station Chandaus District
Aligarh be released on bail on his furnishing a personal bond with
two sureties each in the like amount to the satisfaction of the court
concerned.
