2. 29.7.2011. Heard learned counsel for petitioners and learned

counsel for the State.

It is submitted that offence under section 307 of the

Indian Penal Code would not be made out in the back ground of the

fact that occurrence took place due to quarrel between children of

two families and for which case and counter case have been lodged

and furthermore injury report attached with the case diary shows

both injuries sustained by the injured are laceration, bruise, swelling,

abrasion and bite mark to which the doctor opined to be simple in

nature caused by hard and blunt substance.

Taking into consideration the aforesaid submissions, let

the petitioners, namely, 1.Ashok Singh, 2.Uday Singh, 3.Sanjay

Singh @ Sanjay Kumar Singh and 4.Vikash Kumar in the event of

their arrest or surrender before the court below within a period of

four weeks from the date of receipt/communication of the order be

released on bail on furnishing bail bonds of Rs.5,000/- (five

thousand) with two sureties of the like amount each to the

satisfaction of C. J. M., Kaimur at Bhabua in connection with

Bhagwanpur P.S. Case No.34 of 2011.
