During
the course of hearing of these two petitions certain records were
produced by Ms. M.D. Mehta, the learned AGP appearing for the
respondents, which prima facie indicate that the notice has been
served on the petitioners. Mr. Tolia, the learned advocate appearing
for the petitioners, however, reiterates his submission that xerox
copy of the notice in question was given to the petitioners only
after the assessment order was passed by the Mamlatdar.
Ms.
Mehta is, therefore, directed to place the relevant documents along
with an affidavit of the responsible person on or before 1.2.2010.
The petitioners are directed to give their response on or before
3.2.2010.
Both
the petitions are therefore adjourned to 4.2.2010. To be placed in
the 1st Board.
