Rule.

Mr.Maulik Nanavati, learned Additional Public Prosecutor, waives
service of rule for respondents.

The
applicant-convict has prayed for temporary bail for attending post
death ceremony of his brother. No case is made out for grant of
temporary bail. The applicant has no force and the same is rejected.
Rule is discharged.

However,
in the facts and circumstances of the case, as and when the accused
applies to the Jail Authorities, the Jail Authorities will facilitate
his visit for attending after death ceremony of his brother, in
custody, for five days.
