ORDER
Rule.
Mr.Nanavati, learned APP wavies service of notice of Rule on behalf
of respondent No.1.
Applicant
is an under-trial prisoner, who has submitted this application
through Jail. He seeks temporary release from judicial custody on
the ground of the marriage of his niece, which is scheduled on
12/10/2008.
I
have heard Mr.Nanavati, learned APP and also have gone through the
record of the case. Applicant-accused is earlier released on
temporary bail for a limited period on account of his niece’s
marriage and the marriage of his brother-in-law and the Jail record
shows that he has surrendered in time.
In
view of the above and in view of the fact of marriage of niece of the
applicant, following order is passed.
Applicant-under-trial
prisoner-ATUL
NARANBHAI PATEL is ordered to be released
on temporary bail from the judicial custody for a period of ten days
from 6th October, 2008 till 16th October, 2008
upon his executing a personal Bond of Rs.2,000/- (Rupees Two Thousand
Only) before the Jail Authority on a condition that during the
aforesaid period of temporary bail, the applicant shall mark his
presence before the Nadiad Town Police Station on 10th and
14th October, 2008 between 11:00 a.m. And 5:00 p.m. and
applicant shall surrender to the custody after expiry of the
temporary bail period.
Application
is allowed to the aforesaid extent. Rule made absolute accordingly.
Registry
is directed to communicate to the Jail authority immediately.
