ORAL
ORDER

1. It
is reported that in pursuant to the order passed by this Court dated
09/03/2010, respondent company has deposited Rs.6,00,000/- (Rupees
Six Lacs only) with the Registry of this Court on 20/03/2010.

2. In
view of the above, the petitioner is hereby permitted to withdraw the
aforesaid amount of Rs.6,00,000/- (Rupees Six Lacs only), without
prejudice to the rights and contentions of the respective parties in
the main Company Petition and on undertaking to be filed by the
petitioner that if ultimately it is found that any excess amount is
paid to the petitioner, the same shall be refunded/returned within
stipulated time that may be given by this Court. Such an undertaking
shall be filed by the petitioner within a period of one week from
today.

3. Mr.Chhatrapati,
learned advocate appearing on behalf of the respondent does not
invite any reasoned order permitting the petitioner to withdraw the
amount of Rs.6,00,000/- (Rupees Six Lacs only) and, therefore, this
Court is not assigning any reasons while permitting the petitioner to
withdraw the aforesaid amount of Rs.6,00,000/- (Rupees Six Lacs
only). S.O. to 05/04/2010.
