It is contended by the learned counsel for the appellant that in the present
case mob committed the alleged offence in which some persons sustained
injuries, some of the co-accused persons were named in the F.I.R. and
some of the persons were made the accused during investigation. The
charge sheet against the co-accused Jamshed, Khaliq, wali and Gappu has
also been submitted and they were convicted by the trial court on
8.5.2007, against the judgment dated 8.5.2007 the co-accused Jamshed
filed a criminal appeal no. 3041 of 2007, the same has been admitted and
Jamshed has been released on bail by another bench of this court on
25.5.2009, the co-accused Khaliq, wali and Gappu filed criminal appeal
no. 3340 of 2007, the same has been admitted and they have been
released on bail by another bench of this court on 23.5.2007, the case of
the appellant is on the same footing with the above mentioned co-
accused.
Let the appellant Ayub convicted in S.T. No. 845 of 2007 under Sections
307/149,332/149,333/149,342,147 I.P.C. P.S. Shahpur District
Muzaffarnagar be released on bail on his furnishing a personal bond and
two sureties each in the like amount to the satisfaction of the Court
concerned.
The realization of fine shall remain stayed during the pendency of the
appeal.
